What Counts as Service of Process

• A summons and complaint opening a civil lawsuit
• A subpoena demanding records or testimony
• Garnishments, writs, or other court-ordered collection actions
• Any other filing South Dakota courts require to be formally served on a business entity

Regular mail — invoices, marketing offers, renewal notices — is not service of process, even when it's addressed the same way and arrives the same week.

South Dakota's business entity statutes (SDCL Title 47, including the LLC provisions in Chapter 47-34A) require every LLC and corporation registered in the state to keep an agent with a South Dakota address on file specifically so courts and process servers have a dependable place to deliver legal papers. Skip this requirement, or let your agent lapse, and South Dakota courts can authorize alternative methods of service — which is how businesses end up with a default judgment they never saw coming.
